Legal fees
Our fees cover all the work required to complete the sale of your home, including acting for the lender to redeem any existing mortgages on your property.
The average cost for a straightforward freehold residential sale is between £950 and £4,000 (plus VAT currently 20%).
The average cost for a straightforward leasehold residential sale is between £950 and £4,000 (plus VAT currently 20%).
There are a number of factors that could make the matter more complex which will increase these costs. These can include but not limited to:-
- Title issues;
- Restrictive Covenants;
- Lack of Easements;
- Obtaining indemnity insurance for lack of documents;
- Numerous additional enquiries raised by the buyers solicitor;
- All parties to the transaction are cooperative and there is no unreasonable delay from third parties;
- Preparation of additional documents ancillary to the main transaction;
Disbursements
Disbursements are costs relating to your matter that are payable to third parties. We will handle payments and disbursements on your behalf to ensure a smooth process. You will be provided with a full list of disbursements in our formal quotation. Typical disbursements will include:-
- Title Information documentation;
- Electronic money transfer fees £35.00 plus VAT;
- Priority Search £3.00.
On a Leasehold purchase you may also incur disbursements payable to the Landlord or their representatives. These disbursements can vary significantly as they depend on what the Landlord charges. You may wish to ask the agent to check this information before you make an offer. Examples of these disbursements include:-
- Deed of Covenant fee. This fee is provided by the management company for the property and can be difficult to estimate. Often it is between £50 - £250;
- Certificate of Compliance fee – to be confirmed upon receipt of the Lease, as can range between £10 and £150;
- Management Pack fee often from between £100 - £350.
How long will my house sale take?
How long it will take from your acceptance of an offer to the final sale of the property will depend on a number of factors. The average process takes between 12 – 16 weeks.
It can be quicker or slower depending on the parties in the chain.
Stages of the Processes
The precise stages involved in a sale of a residential property vary accordingly to the circumstances. As part of the process we will:
- Take your instructions and give you initial advice;
- Obtain redemption figure from your lender to ensure there is no negative equity;
- Submit contract documents;
- Undertaking regulatory checks;
- Giving you advise on all documents and information received;
- Responding to enquiries of the Purchaser’s solicitor;
- Advising on any mortgage redemption if appropriate;
- Sending final contract to you for signature;
- Agree completion date (date from which you leave the property);
- Exchange contracts and notify you that this has happened;
- Obtain the final redemption statement from your mortgage company;
- Complete sale;
- Discharge any legal charge and provide you with payment of the remaining balance.
